Preparing a site workforce for the legal reality of union right of entry

The problem

When Interflow took on a major new contract with Sydney Water at the North Head Wastewater Treatment Plant, it brought a new set of legal obligations. Every person on site  (employees and subcontractors alike) needed to know how to handle a right of entry visit from a union official or WHS Inspector.

 

For a workforce not previously exposed to this area of the law, it was genuinely unknown territory.

Right of Entry sits at the intersection of the Fair Work Act and Workplace Health and Safety legislation. The challenge wasn't just communicating the rules - it was making sure people could apply them confidently in the moment, when someone turns up at the site gate.

Our solution

We developed a 15-minute eLearning module in Articulate Rise, as part of a broader five-module induction suite. The central design principle was straightforward: rather than telling people what the law says, put them in the situation and let them work it out.

A recurring site character (Dave, familiar to learners from the broader induction program) guided learners through the content in a way that felt connected rather than like a standalone compliance module.

Lesson one established the legal framework: who can enter, under what circumstances, and what they can and can't do once on site. Flip cards and a sorting activity made the rules tangible rather than abstract.

The real design work happened in lesson two. Learners were placed directly into scenario-based conversations at the site gate, choosing their response at each stage of a real interaction. Consequence-led feedback explained not just whether they were right or wrong, but why, and what they should do instead.

Responsibilities were differentiated by role throughout. Supervisors and team members received content specific to their obligations, ensuring no one was given information that didn't apply to them.

The outcome

The full five-module induction suite is available to employees through Interflow's LMS and to subcontractors through their onboarding portal - ensuring everyone on site has completed the same induction before work begins, regardless of how they're engaged.

 

For a workforce taking on new site responsibilities, having that consistency in place from day one matters. Every person on site can now respond correctly if a union official or WHS Inspector arrives, confident in what to do and who to contact.
